1. Condition and Authenticity
All items are sold strictly “as is, where is”, with all faults included. Bidders must satisfy themselves as to the condition, authenticity, provenance, and title of each lot before bidding. There are no guarantees or warranties expressed or implied.
2. Bidding Procedure & Registration
• By phone: Complete and submit the Telephone Bid Form by 5:00 pm the day before auction. Secure your bid with a valid credit card. Intervendue will make a good-faith effort to contact you in relation to each lot. We assume no liability for missed calls or human error.
• Online: We make reasonable efforts to process your online bids. However, Intervendue is not liable for technical malfunctions, network failures, or latency issues.
• Responsible for bidding: The winning bid constitutes a legally binding contract of sale, even in cases of tied bids.
3. Title Transfer & Risk of Loss
Title to a lot transfers to the buyer immediately upon the fall of the auctioneer’s hammer—risk passes at that moment. Intervendue will store items carefully, but is not responsible for loss, damage, or theft once the hammer falls.
4. Sales Tax & Duties
Florida Sales Tax (7%) applies unless the buyer provides a valid Florida tax-exempt ID or out-of-state exemption. We do not recognize sales-tax exemptions from other states or jurisdictions.
5. Payment Terms
• Payment is due within 5 business days of the auction; not later than 7 days to avoid penalties.
• Accepted methods: Visa, MasterCard (with full documentation), cash (in-house), personal or cashier’s check, money order, wire transfer, or PayPal.
• Purchases above $1,500 must be paid by wire transfer, cashier’s or personal check.
• Purchases above $5,000: wire transfer or cashier’s/personal check only.
6. Shipping and Insurance
• Shipping costs are the buyer’s responsibility. Choose your own shipper or use our recommended partners (UPS Store Aventura, Parcel Pro).
• Insurance is available at US $1 per US $100 of item value; included on your invoice by default.
• Prohibited items (e.g. ivory, weapons, restricted animal skins) cannot be shipped internationally. Consult with a third-party shipper for potential exceptions.

9. Withdrawal of Lots
Intervendue reserves the right to withdraw or cancel any lot at any time—prior to the issuance of invoice, or upon discovering errors in cataloging, misrepresentation, or technical issues. No claim for damages will be accepted in such instances.
10. No Returns and Refund Policy
All sales are final. Refunds are granted solely at the discretion of Intervendue. Buyers have no automatic right to return items after the sale.
11. Governing Law and Jurisdiction
Any disputes arising from the auction will be governed by the laws of the State of Florida. The courts located in Miami-Dade County shall have exclusive jurisdiction.

All property is sold “as is, where is” and all sales are final. No returns, refunds, or exchanges are permitted except as expressly provided below.
Condition of Lots
Descriptions, condition reports, photographs, and statements in catalogs or online listings are provided for guidance only and do not constitute a warranty. Buyers are responsible for inspecting lots and satisfying themselves as to condition, authenticity, provenance, and suitability prior to bidding.
Limited Authenticity Guarantee
The auction house guarantees the authenticity of a lot only to the extent specifically stated in the catalog description. If a lot is proven to be a material forgery or misattributed, the buyer must notify the auction house in writing within 3 days of the sale date and provide independent expert evidence acceptable to the auction house.
If a claim is accepted, the buyer’s sole remedy is rescission of the sale and a refund of the hammer price (and buyer’s premium, if applicable). No other damages or costs will be paid.

Shipping & Collection
Risk of loss passes to the buyer upon the fall of the hammer. The auction house is not responsible for damage occurring during shipping or handling by third parties.
Governing Law
This policy and all sales conducted by the auction house shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to this policy or any auction sale shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and the parties hereby consent to the personal jurisdiction and venue of such courts.
